When estates contest

Italian succession is built to settle out of court: the notary publishes, the heirs declare, the registry updates. Litigation is the exception, and when it comes the disputes tend to repeat.

A contested will

Impugnazione on grounds of incapacity, formal defect, undue influence, or forgery. The action runs against every heir who benefits, and expert handwriting analysis is often decisive.

A share clawed back

An azione di riduzione by a legittimario cut below their reserve. The court reconstitutes the estate, lifetime gifts included, and orders restitution within ten years of acceptance.

An estate that won't divide

Divisione giudiziale when co-heirs cannot split an indivisible asset: a villa, an art collection, a company. The court can order a sale and distribute the proceeds.
